Limited 15-Year Warranty – Residential Polyaspartic Garage Floor Coatings
 
Thank you for choosing Elegant Coatings to install your polyaspartic garage floor coating. We appreciate your business and are committed to delivering high-quality workmanship and materials.
 

Coverage

This limited warranty applies only to the original residential purchaser (non-transferable) for polyaspartic garage floor coating materials professionally installed by Elegant Coatings in a residential garage up to 5,000 square feet.The warranty covers the following for 15 years from the date of installation:

  • Peeling or delamination of the coating from the concrete substrate solely due to improper surface preparation or defective materials provided and applied by Elegant Coatings.
  • UV-induced “ambering” or discoloration of the coating due to defects in the materials.

This warranty does NOT cover any other issues, including but not limited to normal wear and tear, fading from regular use/exposure, or any problems related to the underlying concrete.

Exclusions
Elegant Coatings is not responsible for, and this warranty does not cover:

  • Any damage, peeling, delamination, or failure caused by issues with the underlying concrete substrate, including but not limited to cracking, shifting, movement, settling, or defects in the concrete; moisture vapor transmission, hydrostatic pressure (including levels above 8 lbs. per calcium chloride test), efflorescence, or osmotic blistering; any pre-existing or future conditions in the concrete slab.
  • Normal wear and tear, scratches, chipping, staining, or fading from regular use.
  • Misuse, neglect, abuse, extreme temperatures, dropping heavy objects, dragging items, or impacts that damage the concrete underneath.
  • Improper maintenance, harsh chemical spills (e.g., battery acid, brake fluid, industrial fluids), or failure to promptly clean spills.
  • Repairs, modifications, or attempts to repair made by anyone other than authorized Elegant Coatings personnel.
  • Damage from accidents, casualties, natural disasters, hot tires, vehicle fluids, or environmental conditions beyond normal residential garage use.
  • Installations in commercial, rental, or non-residential properties.

Important Note on Concrete Issues

We do not install, control, or warrant the concrete slab itself. Concrete is a separate material poured by others, and issues such as cracking, moisture problems, or substrate defects are common and outside our scope. If such issues arise, they may cause the coating to fail, and this is not covered under this warranty.

Claims Process
To file a claim, provide written notice within 30 days of noticing the issue, along with proof of purchase, photos, and access for inspection. If covered, Elegant Coatings will, at our sole discretion, repair or recoat the affected area (materials and labor only; additional costs like travel may apply outside our service area).

Disclaimer and Limitation of Liability
THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY ELEGANT COATINGS. WE EXPRESSLY DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WHETHER STATUTORY OR OTHERWISE.
Our liability is limited to the original purchase price of the affected coating installation (repair or replacement at our option). Under no circumstances will Elegant Coatings be liable for special, incidental, consequential, or punitive damages, including but not limited to property damage, personal injury, loss of use, lost profits, or any other losses arising from the installation, use, or failure of the floor coating.

This warranty is governed by the laws of Alberta, Canada.


Epoxy Training Course – Payment & Cancellation Policy

By registering and paying for the Elegant Coatings Epoxy Training Course, you agree to the following:

  • All payments are final and non-refundable.
  • No refunds will be issued for any reason (including changes in schedule, illness, weather, or personal circumstances).
  • If you are unable to attend your scheduled date, we will issue a training credit valid for 12 months from the original payment date. The credit is non-transferable.
  • Elegant Coatings reserves the right to reschedule or cancel a training date due to insufficient enrollment or unforeseen circumstances. In such cases, we will offer a training credit at our discretion.

Your registration and payment confirm that you have read and accepted this policy.


Liability, Pre-Existing Conditions & Site Safety Acknowledgement

Pre-Existing Conditions

  • Concrete surfaces can have hidden defects (moisture vapor transmission, cracks, delamination, spalling, etc.).
  • Elegant Coatings is not responsible for pre-existing issues with the concrete substrate that become visible after surface preparation or coating application.
  • Any additional repairs required due to pre-existing conditions may result in extra charges.

Hazardous Materials & Safety

  • I agree to inform Elegant Coatings in advance of any known hazards on site, including (but not limited to) asbestos, mold, lead, chemicals, or structural issues.
  • I understand that failure to disclose hazards may result in project delays or cancellations.

Insurance
Elegant Coatings is fully insured and covered by WCB (Workers’ Compensation Board).
General Liability
Our liability is limited to the total value of the project. We are not responsible for damage caused by factors beyond our reasonable control (including concrete moisture issues, humidity, temperature fluctuations, or third-party interference).

I have read, understood, and agreed to the above terms.


Payment Processing Policy

We accept the following payment methods:

  • e-Transfer – Free (preferred)
  • Bank Payment – 1% fee
  • Credit Card – 3% fee

If you wish to pay by bank payment or credit card, please notify us before the final invoice is issued so we can add the applicable fee to your invoice.

All payments must be made in full upon project completion unless other arrangements have been agreed upon in writing.


Photo Release & Privacy Acknowledgement

I hereby grant Elegant Coatings, its owners, and representatives permission to take and use photographs and videos of my completed project for promotional, advertising, and marketing purposes. This includes use on our website, social media (Facebook, Instagram, etc.), Google reviews, advertising materials, and portfolios.

  • My full address or personal contact information will not be published with any images.
  • I waive any right to compensation or approval of the finished images or wording.

Privacy Acknowledgement
I understand that Elegant Coatings collects my name, contact information, and project photos solely for the purpose of completing the job, invoicing, and providing customer service. Elegant Coatings will not sell or share my personal information with third parties for marketing purposes. I may request removal of my project photos at any time by contacting the company.

By proceeding with the project, I agree with both the Photo Release and Privacy Acknowledgement.


Elegant Coatings – Terms & Conditions

These Terms & Conditions apply to all estimates, agreements, and services provided by Elegant Coatings.

  1. Payment Terms
    • A 50% deposit is required to schedule any project and secure materials.
    • The remaining balance is due in full upon completion
    • All deposits and payments are final and non-refundable.
  2. Warranty
    Warranty is offered only on Garage Floor Coating Systems. No warranty applies to other polyaspartic flakes systems, solid color systems, decks, patios, exterior coatings, or metallic systems unless explicitly stated in a separate written warranty.
  3. Appearance & Limitations
    Urethane topcoats may show roller lines. We are not responsible for imperfections (bubbling, fisheyes, etc.) caused by humidity, temperature, moisture vapor, poor ventilation, insects, or other conditions outside our control.
  4. Customer Responsibilities
    • Provide clear access and remove all items from the work area.
    • Disclose any known hazards (asbestos, etc.).
    • Inform us of any desired payment method other than e-Transfer.
  5. Changes & Cancellation
    Once materials are ordered, changes or cancellations may result in loss of deposit and/or additional charges. We reserve the right to charge for any unforeseen work or repairs not included in the original estimate.
  6. Photos & Privacy
    We may use project photos for marketing (no address shown). See our Photo Release & Privacy Acknowledgement.

By accepting our estimate, you agree to these Terms & Conditions.


Worksite Conditions & Project Preparation Clause (Commercial Projects)

  1. Project Deposit & Material Sourcing
    To secure the project start date and facilitate material procurement, a non-refundable deposit of 50% is required exactly fourteen (14) days prior to the scheduled mobilization date. Materials will not be ordered, and the project date will not be finalized until this deposit is received in full.
  2. Environmental & Site Conditions
    The Contractor (or Client) is responsible for ensuring the job site meets the following technical and environmental specifications prior to the arrival of the installation crew:
    • Power Requirements (Mandatory): The Contractor must provide continuous, dedicated, and reliable 220V power on-site, capable of running heavy-duty concrete grinders and industrial dust-extraction vacuums simultaneously. It is the Contractor’s sole responsibility to ensure this power is live, tested, and accessible within the immediate work area prior to our arrival. Standard 110V outlets must also be functional and available.
    • Temperature Control: The ambient air temperature and the concrete slab temperature must be maintained at a minimum of 15°C (59°F) for at least 24 hours prior to, during, and 48 hours after the application process to ensure proper chemical curing.
    • Lighting: Adequate, functional lighting must be provided throughout the entire work area. This may include overhead site lighting, standard string lights, or heavy-duty contractor lights. Crew must have sufficient visibility to inspect the slab and ensure a flawless finish.
    • Site Cleanliness: The work area must be delivered clean, dry, and completely free of dust, dirt, standing water, oil, construction debris, or stored materials.
  3. Exclusive Access & Contamination Prevention
    Due to the highly sensitive chemical nature of epoxy coatings, the installation area must be a restricted zone. No other trades, contractors, or personnel shall be permitted in or around the workspace during prep, application, and the mandatory curing window. Any dust, debris, or foot traffic from other trades can cause permanent surface contamination and damage, resulting in charges for repairs or cleanup.
  4. Non-Compliance and Delay Fees
    If any of the above conditions are not fully met upon the arrival of the installation crew, the project will be immediately halted. The project will not commence or resume until all conditions—specifically including adequate 220V power and proper slab temperatures—are verified as compliant. Any delays, rescheduling, or dry-run mobilizations caused by unmet site conditions will result in a Delay & Rescheduling Fee of $500 per day, plus any additional labor and mobilization costs incurred. YYC Elegant Coatings Corp is not responsible for project schedule delays resulting from a failure to meet these site readiness requirements.

Metallic Epoxy Flooring Agreement & Project Specifications

1. Scope of Work & Color Specifications
YYC Elegant Coatings Corp (hereafter referred to as “Contractor”) agrees to provide all labor, materials, and equipment necessary to install a custom metallic epoxy floor coating system at the address listed above. The Client has selected and agreed upon the following color blend:

2. Artistic Disclaimer & Nature of Metallic Epoxy
 
Metallic epoxy is a fluid, living art medium. It is a completely custom finish, and no two floors will ever be identical. By signing this agreement, the Client acknowledges and agrees to the following aesthetic terms:

  • Unique Variations: Every metallic installation behaves differently. The Contractor cannot duplicate or make the floor look exactly like a photo, sample board, or past project shown to the Client. Samples are meant to represent color combinations only, not final patterns or movement.
  • Installer Discretion: At the end of the day, the final design, flow, and look of the floor are in the hands of the installer. The Contractor will use professional techniques to achieve a look as close to the Client’s vision as possible, but final outcomes cannot be micro-managed or strictly controlled.
  • Natural Movement & Gravity: Epoxy is a self-leveling liquid. Depending on the existing slopes, pitches, drains, or imperfections in the concrete substrate, the epoxy will move on its own as it cures, creating its own unique designs, cells, and color separations.

3. Surface Conditions, Dust, and Imperfections
Because this coating is applied as a liquid in a non-sterile environment, a perfectly flawless surface is technically impossible.

  • 2% to 3% Margin for Imperfections: The Client accepts that a 2% to 3% variance/margin for minor imperfections is standard and acceptable in the industry. This includes, but is not limited to, minor dust nibs, microscopic air bubbles (outgassing), lint, or tiny texture variations.
  • Substrate Defects: The Contractor is not responsible for cracks, shifting, or settling that occurs in the underlying concrete after the project is completed. If the concrete moves, the epoxy may crack with it.
  • Moisture Disclaimer: The Contractor is not liable for future coating failures (such as bubbling, delamination, or peeling) caused by hydrostatic pressure or moisture vapor transmission originating from underneath or outside the concrete slab.

4. Client Responsibilities & Jobsite Environment
To ensure a successful installation, the Client agrees to provide the following conditions:

  • Climate Control: The area must be climate-controlled. Indoor temperatures must be maintained between 65°F and 75°F for 24 hours before, during, and 48 hours after the installation. Fluctuations in temperature can ruin the curing process.
  • Site Access & Exclusivity: No other trades, people, or pets are allowed in or around the work area during application and curing. The Contractor is not responsible for damage caused by third-party footprints, dust from other construction, or debris introduced by others.
  • Utilities: The Client must provide consistent access to electricity and water on-site.

5. Payment Terms & Schedule
Total project cost is agreed upon prior to installation date.
Payment shall be made according to the following strict schedule. Failure to pay balances when due will result in an immediate halt to work and may void warranties.

Note: “Substantial completion” means the floor is coated and top-coated. Final payment cannot be withheld or delayed due to minor touch-ups, waiting for the floor to cure to walk on it, or aesthetic preferences that contradict Section 2 of this agreement.6. Acceptance of Terms & Signatures
The Client certifies that they have read, understood, and agreed to all terms, specifically acknowledging the artistic nature of metallic epoxy, the allowance for minor imperfections, and the payment schedule.
